2) Data collection when visiting our website

When using our website for information purposes only, i.e. if you do not register or otherwise provide us with information, we only collect data that your browser transmits to our server (so-called “server log files”). 4) Contact

When contacting us (e.B. via contact form or e-mail), personal data is collected. Which data is collected when using a contact form can be seen from the respective contact form. This data is stored and used exclusively for the purpose of answering your request or for establishing contact and the associated technical administration. The legal basis for the processing of this data is our legitimate interest in answering your request in accordance with Art. 6 para. 1 lit. f GDPR. If your contact is aimed at the conclusion of a contract, the additional legal basis for the processing is Art. 6 para. 1 lit.b GDPR. Your data will be deleted after your request has been processed. This is the case if it can be inferred from the circumstances that the facts in question have been conclusively clarified and provided that there are no statutory retention obligations to the contrary.

5) Data processing when opening a customer account and for contract processing

In accordance with Art. 6 para. 1 lit.b GDPR, personal data will continue to be collected and processed if you provide it to us for the execution of a contract or when opening a customer account. Which data is collected can be seen from the respective input forms. A deletion of your customer account is possible at any time and can be done by sending a message to the above address of the person responsible. We store and use the data provided by you for contract processing. After completion of the contract or deletion of your customer account, your data will be blocked with regard to tax and commercial retention periods and deleted after expiry of these periods, unless you have expressly consented to further use of your data or a legally permitted further use of data has been reserved by us.

6) Use of customer data for direct marketing

6.1 Registration for our e-mail newsletter

If you subscribe to our e-mail newsletter, we will regularly send you information about our offers. The only mandatory information for sending the newsletter is your e-mail address. The provision of further data is voluntary and will be used to address you personally. For the dispatch of the newsletter we use the so-called double opt-in procedure. This means that we will only send you an e-mail newsletter if you have expressly confirmed to us that you consent to receive newsletters. We will then send you a confirmation e-mail with which you will be asked to confirm by clicking on a corresponding link that you want to receive the newsletter in the future.

By activating the confirmation link, you give us your consent for the use of your personal data in accordance with Art. 6 para. 1 lit. a GDPR. When registering for the newsletter, we store your IP address entered by the Internet Service Provider (ISP) as well as the date and time of registration in order to be able to trace a possible misuse of your e-mail address at a later date. The data collected by us when registering for the newsletter will be used exclusively for the purpose of advertising by means of the newsletter. You can unsubscribe from the newsletter at any time via the link provided for this purpose in the newsletter or by sending a corresponding message to the person responsible named at the beginning. After unsubscribing, your e-mail address will be deleted immediately from our newsletter distribution list, unless you have expressly consented to further use of your data or we reserve the right to use your data beyond this, which is permitted by law and about which we inform you in this declaration.

6.2 Sending the e-mail newsletter to existing customers

If you have provided us with your e-mail address when purchasing goods or services, we reserve the right to regularly send you offers for similar goods or services, such as those already purchased, from our range by e-mail. For this purpose, we do not have to obtain any separate consent from you in accordance with § 7 Abs. 3 UWG. In this respect, data processing takes place solely on the basis of our legitimate interest in personalized direct advertising in accordance with Art. 6 para. 1 lit. f GDPR. If you have initially objected to the use of your e-mail address for this purpose, we will not send an e-mail. You are entitled to object to the use of your e-mail address for the aforementioned advertising purpose at any time with effect for the future by notifying the person responsible named at the beginning. For this purpose, you will only incur transmission costs according to the basic tariffs. Upon receipt of your objection, the use of your e-mail address for advertising purposes will be stopped immediately.

7) Data processing for order processing

7.1 Insofar as necessary for the execution of the contract for delivery and payment purposes, the personal data collected by us will be passed on to the commissioned transport company and the commissioned credit institution in accordance with Art. 6 para. 1 lit.b GDPR.

If we owe you updates for goods with digital elements or for digital products on the basis of a corresponding contract, we process the contact data provided by you when ordering (name, address, e-mail address) in order to personally inform you personally within the framework of our legal information obligations in accordance with Art. 6 para. 1 lit.c GDPR by appropriate means of communication (e.g. by post or e-mail) about upcoming updates within the legally provided period inform. Your contact data will be used strictly for a specific purpose for notifications about updates owed by us and will only be processed by us for this purpose to the extent necessary for the respective information.

In order to process your order, we also work together with the following service provider(s), who support us in whole or in part in the execution of concluded contracts. Certain personal data will be transmitted to these service providers in accordance with the following information.

7.2 Use of payment service providers (payment services)

– Stripe
If you opt for a payment method from the payment service provider Stripe, payment will be processed by the payment service provider Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland, to whom we will provide your information during the ordering process together with the information about your order (name, address, account number, bank code, possibly credit card number, invoice amount, currency and transaction number) in accordance with Art. 6 para. 1 lit.b GDPR. Stripe reserves the right to carry out a credit check on the basis of mathematical-statistical procedures in order to safeguard the legitimate interest in determining the solvency of the user. Stripe may transmit the personal data necessary for a credit check and received in the context of payment processing to selected credit agencies, which Stripe will disclose to users upon request. The credit report can contain probability values (so-called score values). As far as score values are included in the result of the credit report, they have their basis in a scientifically recognized mathematical-statistical procedure. Among other things, but not exclusively, address data is included in the calculation of the score values. Stripe uses the result of the credit check with regard to the statistical probability of default for the purpose of deciding on the right to use the chosen payment method.
You can object to this processing of your data at any time by sending a message to Stripe or the commissioned credit agencies.
However, Stripe may still be entitled to process your personal data if this is necessary for contractual payment processing.

8) Tools and Miscellaneous

– DATEV
For the execution of the accounting we use the cloud-based accounting software of DATEV eG, Paumgartnerstr. 6-14, 90429 Nuremberg (“DATEV”).
DATEV processes incoming and outgoing invoices as well as, if necessary, the bank movements of our company in order to automatically record invoices, match them to the transactions and create financial accounting from them in a semi-automated process.
If personal data is also processed here, the processing is carried out in accordance with Art. 6 para. 1 lit. f GDPR on the basis of our legitimate interest in an efficient organization and documentation of our business processes.

9) Rights of the data subject

9.1 The applicable data protection law grants you the following rights of data subjects (rights of information and intervention) vis-à-vis the controller with regard to the processing of your personal data, whereby reference is made to the legal basis stated for the respective exercise requirements:

  • Right to information in accordance with Article 15 GDPR;
  • Right to rectification pursuant to Article 16 GDPR;
  • Right to erasure in accordance with Article 17 GDPR;
  • Right to restriction of processing pursuant to Article 18 GDPR;
  • Right to information pursuant to Article 19 GDPR;
  • Right to data portability in accordance with Article 20 GDPR;
  • Right to revoke granted consent in accordance with Article 7 (3) GDPR;
  • Right to lodge a complaint pursuant to Article 77 GDPR.

9.2 RIGHT TO OBJECT

IF WE PROCESS YOUR PERSONAL DATA IN THE CONTEXT OF A BALANCING OF INTERESTS ON THE BASIS OF OUR OVERRIDING LEGITIMATE INTEREST, YOU HAVE THE RIGHT AT ANY TIME TO OBJECT TO THIS PROCESSING WITH EFFECT FOR THE FUTURE FOR REASONS ARISING FROM YOUR PARTICULAR SITUATION.
IF YOU EXERCISE YOUR RIGHT TO OBJECT, WE WILL STOP PROCESSING THE DATA CONCERNED. HOWEVER, WE RESERVE THE RIGHT TO FURTHER PROCESSING IF WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING THAT OUTWEIGH YOUR INTERESTS, FUNDAMENTAL RIGHTS AND FREEDOMS, OR IF THE PROCESSING SERVES TO ASSERT, EXERCISE OR DEFEND LEGAL CLAIMS.

IF YOUR PERSONAL DATA IS PROCESSED BY US FOR DIRECT MARKETING PURPOSES, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH ADVERTISING. YOU CAN EXERCISE THE OBJECTION AS DESCRIBED ABOVE.

10) Duration of storage of personal data

The duration of the storage of personal data is based on the respective legal basis, the purpose of the processing and – if relevant – additionally on the basis of the respective statutory retention period (e.B. commercial and tax retention periods).

When processing personal data on the basis of explicit consent in accordance with Art. 6 para. 1 lit. a GDPR, this data will be stored until the data subject revokes his consent.

If there are statutory retention periods for data that are processed within the framework of legal or quasi-contractual obligations on the basis of Art. 6 para. 1 lit.b GDPR, these data will be routinely deleted after expiry of the retention periods, provided that they are no longer required for the fulfilment or initiation of the contract and/or there is no legitimate interest in further storage on our part.

When processing personal data on the basis of Art. 6 para. 1 lit. f GDPR, this data will be stored until the data subject exercises his or her right to object pursuant to Article 21 (1) GDPR, unless we can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or the processing serves to assert, exercise or defend legal claims.

When processing personal data for the purpose of direct marketing on the basis of Art. 6 para. 1 lit. f GDPR, this data will be stored until the data subject exercises his right of objection pursuant to Art. 21 para. 2 GDPR.

Unless otherwise stated in the other information in this declaration on specific processing situations, stored personal data will otherwise be deleted when they are no longer necessary for the purposes for which they were collected or otherwise processed.
